Terms of Service
Last updated
These Terms explain the rules for using UptimePilot: what we provide, what we expect from you, how billing works, and what happens if something goes wrong. We've tried to keep them short and in plain English.
01Who we are and this agreement
UptimePilot (the "Service") is operated by Tejasree Kode, a sole proprietor based in Hyderabad, India, trading as UptimePilot ("we", "us"). These Terms of Service ("Terms") are a binding agreement between us and you, the person or organisation that creates an account or uses the Service ("you").
By creating an account, starting a trial, or paying for a plan, you agree to these Terms, our Privacy Policy and our Refund & Cancellation Policy. If you accept on behalf of a company, you confirm you have authority to bind it. You must be at least 18 years old.
02The Service
UptimePilot checks websites, APIs, SSL certificates, domains, DNS records, ports, hosts and cron-job heartbeats that you configure, records the results, opens incidents and sends alerts through the channels you connect (for example email, Slack, Microsoft Teams, PagerDuty or webhooks).
We may improve, change or remove features over time. If we remove a feature that is central to a paid plan you are using, we will tell you in advance and you may cancel under the Refund & Cancellation Policy.
03Accounts and workspaces
- Give accurate sign-up information and keep your email address up to date — we send alerts, receipts and security notices there.
- Keep your password, two-step verification codes and API keys secret. You are responsible for activity under your account and your API keys. Tell us promptly at [email protected] if you suspect unauthorised access.
- Data belongs to a workspace. Workspace owners control who has access, what role each member has, billing, and deletion of the workspace. If you invite people, you are responsible for their use of the workspace.
- We may refuse or close accounts created with false information, automated sign-ups, or to evade a previous suspension.
04Acceptable use
Only monitor targets you own or are authorised to test. Each check sends real network traffic (HTTP requests, TCP connections, ICMP pings and DNS lookups) to the target. You confirm that you own each URL, host, IP address or domain you add, or have the owner's permission to probe it at the frequency you choose.
You must not use the Service to:
- scan, probe, load-test or attack systems without permission, or to cause denial of service by stacking frequent checks on one target;
- reach private, internal or cloud-metadata addresses you are not entitled to access, or try to bypass our network safeguards;
- send spam or unlawful content through notification channels or webhooks;
- break the law, infringe others' rights, or host or distribute malware;
- interfere with the Service, other customers, or our infrastructure, or try to access data that isn't yours;
- resell the Service or share one paid workspace across unrelated organisations without our written consent.
We may pause individual monitors, rate-limit requests, or suspend a workspace that breaks these rules or puts others at risk. Where practical we will contact you first and explain why.
05Plans, trial and billing
- Free trial. Each new workspace gets a 7-day free trial, with the limits shown on our pricing page (currently 5 monitors checked every 5 minutes); no card is needed. When the trial ends, monitoring pauses (checks stop and no alerts are sent) until the workspace pays for a plan. Nothing is deleted except check history older than 7 days.
- Prices. Paid plans are priced in Indian Rupees (INR) and shown on the Billing page and our website. We are not registered under GST, so no GST is charged; an invoice is issued for each payment. Where we offer payment in US dollars, the USD price shown at checkout is the amount charged.
- Monthly and yearly billing. You can pay for one month or one year of a plan at a time. A yearly plan costs ten times the monthly price. Each payment buys one period and does not renew automatically: nothing is charged automatically, and you renew by paying again from the Billing page. Renewing early adds the new period after the end of the current one. We remind you by email before a period ends.
- Upgrades and downgrades. Upgrades take effect when payment is confirmed. Moving to a lower plan takes effect as described on the Billing page at the time of the change.
- Payments. Payments are processed by Razorpay Software Private Limited, which receives the payer's name, email address and mobile number to process the payment. We do not see or store your full card, UPI or bank details.
- End of a paid period and non-payment. If a paid period ends without renewal, the plan's limits continue for a short grace period (currently 3 days) and then monitoring pauses: checks stop and no alerts are sent until you pay for a plan. Nothing is deleted except check history older than the plan's history period. Paused monitors resume when you pay. Your account itself is not closed for non-payment: you can still sign in, see your data and pay.
- Refunds. Refunds are governed by our Refund & Cancellation Policy.
- Price and plan changes. We will give at least 30 days' notice by email before changing the price of a plan you are subscribed to. Changes don't affect a period (monthly or yearly) you have already paid for. We may change the free trial's limits with reasonable notice.
06Your data
You keep all rights in the data you put into the Service (monitor settings, URLs, notification settings, incident notes) and in your check results. You give us permission to store and process that data only to provide, secure and improve the Service, as described in the Privacy Policy.
Check history is kept for the period your plan includes and then deleted automatically. You can export your data from Settings → Profile at any time, and delete a workspace or your whole account yourself.
07Availability and no service-level guarantee
We work hard to keep the Service available and alerts timely, but monitoring depends on networks, DNS, third-party messaging services (email, Slack, Teams, PagerDuty and others) and the internet in general. We do not guarantee that every outage will be detected, that every alert will be delivered or delivered within a particular time, or that the Service will be uninterrupted or error-free.
Unless we have signed a separate written service-level agreement with you, no uptime or response-time commitment (SLA) applies and no service credits are owed. UptimePilot is a helpful early-warning tool, not a replacement for your own redundancy, backups, and incident procedures. Scheduled maintenance will be announced in advance where possible.
08Third-party services
Integrations such as Razorpay, Google sign-in, Slack, Microsoft Teams, PagerDuty and your own webhooks are provided by third parties under their own terms. We are not responsible for their availability or for what they do with data you send to them through an integration you set up.
09Our intellectual property
The Service, its software, design and the UptimePilot name and logo belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these Terms while your account is active. Don't copy, reverse-engineer or create derivative works of the Service except as the law allows. Feedback you send us may be used freely to improve the Service.
10Disclaimers and limitation of liability
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business, goodwill or data, including losses caused by an outage that was not detected or an alert that was not delivered.
Our total liability for all claims arising out of or relating to the Service or these Terms is limited to the amount you paid us for the Service in the 3 months before the event giving rise to the claim (or ₹1,000 if you have not paid us anything). Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud.
You agree to indemnify us against third-party claims arising from targets you monitored without authorisation or from your breach of these Terms.
11Suspension, termination and deletion
- You can stop using the Service at any time. Owners can delete a workspace from Settings → Users & Access, and you can delete your account from Settings → Profile. Deletion is permanent.
- We may suspend or terminate your access if you materially breach these Terms (including the acceptable-use rules), if required by law, or if your use creates a security or legal risk. Where reasonable we will give notice and a chance to fix the problem.
- On termination, your right to use the Service ends. We delete workspace data as described in the Privacy Policy, except records we must keep by law (for example, tax invoices).
- Sections that by their nature should survive termination (for example liability, indemnity, governing law) continue to apply.
12Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above shows the current version. For material changes we will give at least 15 days' notice by email or in the app before they take effect. If you keep using the Service after that, the updated Terms apply; if you don't agree, you may cancel before they take effect.
13Governing law and disputes
These Terms are governed by the laws of India. Subject to the paragraph below, the courts at Hyderabad, India have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.
Before going to court, please contact us at [email protected] so we can try to resolve the issue informally within 30 days. Nothing here prevents either party from seeking urgent interim relief.
